Can international trademarks be renewed in China?
In the era of economic globalization, international trademarks are one of the trademarks that enterprises need to apply for. Due to the territorial nature of trademark applications, international trademark applications and maintenance are more difficult than domestic ones, and trademark infringement is inevitable. Moreover, enterprises apply for registration of more than one trademark, often hundreds or thousands, making trademark maintenance also a big problem, and it is inevitable to attend to one thing and lose sight of another. At this time, some people may wonder whether international trademarks can be renewed in China for convenience. Today, Beigua.com conducts an in-depth analysis of this issue.
The application for renewing international trademarks is divided into two types: one is the renewal of trademarks in a single country, and the other is the renewal of Madrid international trademarks. If the trademark applicant chooses a single country when applying for trademark registration, then the renewal of the trademark can be renewed in the above two ways.
According to relevant regulations, the renewal of international trademarks needs to follow certain time limits. The renewal period for international trademark registration is 10 years. Within half a year after the expiration of the international trademark validity period (including the expiration date), if the applicant fails to complete the trademark renewal application within the specified time, the period can be extended by half a year on the original basis. If no application is submitted within the extension period, the international trademark office has the right to cancel the trademark. Like domestic trademarks, if a renewal application is submitted within the specified period, the trademark can be renewed for 10 years.
The applicant submits relevant materials such as a copy of the trademark registration, business license, and renewal application to the international trademark office in accordance with the regulations on trademark renewal. After the international trademark renewal application is submitted, the international trademark office will conduct corresponding reviews. Trademarks that meet the renewal requirements will be registered, announced, and returned to the competent authorities of the designated contracting parties. Once the international trademark office publicizes the trademark for renewal application, the designated contracting parties will legally protect the trademark for renewal application.
If the trademark renewal does not meet the regulations, the international trademark office will return the materials submitted by the applicant and inform the applicant to complete the correction of the materials within the specified period.
